2. Services Provided
FIVE 7 provides:

Residential building design

Conceptual plans

Planning permit drawings

Construction documentation

Consultancy and advisory services related to building and design compliance.

All services are performed in accordance with Australian standards, including the National Construction Code (NCC 2022), and under the regulatory framework of the VBA.

3. Practitioner Registration and Compliance
FIVE 7 holds all relevant and required registrations for design practitioners in Victoria. We comply with:

The Victorian Building Authority’s requirements

Mandatory insurance obligations

Regular Continuing Professional Development (CPD) updates.

We ensure that all documentation prepared by us complies with local council planning schemes, building permit requirements, and Victorian consumer protection laws.

4. Intellectual Property and Copyright
All designs, plans, specifications, drawings, reports, and written material created by FIVE 7 (collectively referred to as “Works”) are and shall remain the sole intellectual property of FIVE 7, unless explicitly transferred by written agreement.

You are prohibited from:

Copying, reproducing, or distributing our Works without express written permission.

Modifying or creating derivative works based on our designs.

Submitting our designs to third parties (including builders, developers, or architects) without our consent.

FIVE 7 enforces its copyright rigorously and aggressively. Any unauthorized use, reproduction, or modification of our intellectual property will result in immediate legal action, including but not limited to:

Seeking injunctive relief

Claiming damages

Pursuing full costs of enforcement, including legal fees.

Our designs are protected under Australian Copyright Law (Copyright Act 1968) and related intellectual property legislation.

5. Fees and Payment
All fees for services provided will be outlined in a formal proposal or client agreement. Unless otherwise agreed in writing:

A deposit is required before work commences.

Final payment must be made prior to delivery of any completed documentation.

Late payments may incur additional charges and interest as permitted under the Australian Consumer Law (ACL).

We reserve the right to withhold services or documentation until full payment is received.

6. Confidentiality
We are committed to maintaining client confidentiality. All personal and project information provided to us will be used solely for the purposes of delivering the contracted services unless otherwise required by law or agreed by the client.

7. Warranties and Liability
While FIVE 7 takes all care to ensure that its services are accurate and comply with legislation, we:

Do not guarantee planning or building permit approvals.

Are not responsible for changes made by third parties or councils after documentation is submitted.

Limit our liability to the amount paid for the services supplied.

To the extent permitted by law, we exclude all implied conditions, warranties, and representations except as expressly stated in these Terms.

8. Client Responsibilities
Clients are responsible for:

Providing accurate and complete information about the project.

Disclosing site constraints or known issues.

Ensuring that all necessary site investigations, surveys, and geotechnical reports are commissioned where necessary.

Delays caused by the client’s failure to provide accurate information may result in project delays or additional fees.

9. Building Permits and Regulatory Approvals
It is the client’s responsibility to engage a registered Building Surveyor for the issuance of building permits. FIVE 7 may assist with preparation but does not issue permits directly.

Designs provided are created in good faith based on current regulations. Changes in legislation or local planning schemes after documentation delivery may require modifications, which may incur additional costs.

10. Building Code Compliance
Our work aligns with:

FIVE 7 is committed to meeting all structural, fire, energy efficiency, accessibility, and sustainability requirements mandated under Victorian building law.

11. Enforcement and Dispute Resolution
FIVE 7 prioritizes the protection of its commercial interests. In the event of:

Breach of copyright

Non-payment

Unauthorized use of documentation

We will immediately seek legal enforcement via litigation, mediation, or alternative dispute resolution processes as necessary. Clients consent to the jurisdiction of courts located in Melbourne, Victoria.

12. Amendments
FIVE 7 reserves the right to amend these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any updated Terms.

13. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes shall be handled exclusively by the courts located within Melbourne, Victoria. Jurisdiction: Melbourne, Victoria, Australia
